Prenuptial Agreements

A prenuptial agreement is entered into between two people who intend to marry. The prenuptial agreement typically identifies the assets and liabilities that each party will bring to the marriage, and how joint assets or liabilities acquired during the marriage will be treated.

Most importantly, the prenuptial agreement specifies how joint property, individual assets and/or financial obligations will be handled in the event that the marriage ends in divorce.

There are certain conditions where a prenuptial agreement can be particularly helpful. Many of these conditions are common to doctors, dentists, attorneys, accountants and other professionals:

  • Salary or asset levels are significantly different between the parties
  • One party owns or is a shareholder in a business entity
  • One or both parties has a high debt load
  • This is not a first marriage

A prenuptial agreement gives you a greater level of control in planning for their family’s future.

Postnuptial Agreements

One common reason for a postnuptial agreement is where one spouse plans to start a new business or become a partner in an existing business (like a doctor who incorporates or joins an existing professional practice). Some partnerships require a prospective partner to enter into a postnuptial agreement stating that their spouse will not make an ownership claim on the business, particularly in the event of marital dissolution or death.

A postnuptial agreement can be entered into either before or after marriage. You may also be interested in reading about our divorce and trust and estate planning services.
